Additional Terms might also be applicable to any promotions and giveaways, if any, that HCS might offer. HCS also reserves the right to correct any typographical errors contained in this Site. The descriptions of any services, contests, giveaways or features offered by HCS also supplements and are a part of these Terms, whether or not such services or features are expressly provided for in these Terms

HCS cannot guarantee that you will receive such notifications, and recommends that you review these Terms and Conditions of Use to check for updates, as often as you decide is necessary.

As with other websites, this one is accessible worldwide. For interested parties accessing the Site from outside of the United States of America, you are solely responsible for verifying that you have the legal right to access this Site. Regardless of where you accessing this Site from, or regardless of where your hunting activities take place, the laws of the State of Indiana, USA will absolutely govern. These Terms apply only to this Site. HCS might from time to time offer Links that might be of interest to you. You should be aware that such Links web-pages are likely to have written terms and conditions and privacy policies of their own that might be significantly different from those of HCS, and even if they do not, will at least be governed by the law of their jurisdiction. HCS has no control whatsoever over such additional terms, and as such, is not responsible in any manner from your use of those Links or any disputes or claims that might arise from your use thereof.

HCS is acting as an intermediary between interested parties of this Site, and has no personal knowledge of such individuals, and has not and will not conduct any investigation as to the qualifications or history of such individuals. You are encouraged, in the process of arranging a hunt, or entering a hunting lease, and prior to signing any written agreement (to the extent that you deem appropriate) to confirm such information.

You can use the information that you obtain from the Site for your personal use only (e.g., to arrange a hunt, or to enter into a hunting lease with a user of the Site). Information obtained from this Site must not be used for any public or commercial purpose (other than for entering into a hunting lease with a Subscriber), or for any purpose that competes with the Site.

"The use of e-mail is critical to ensuring that all Subscribers receive the level of services that they have paid for. Remember that other users of the Site depend on your information being accurate and up to date, just as you want to depend on their information being accurate and up to date. HCS is confident that you will enjoy the privileges that you will have as a Subscriber, but is unable to return all or any portion of your membership fee if any, to you after it has been received. While HCS is committed to making your experiences at the Site enjoyable ones, it can not make and does not make any guarantees of any kind that you will be satisfied with your experiences with this Site, or that the Site will be available at all times. Too many of those variables are simply out of our control. For example, when arranging a hunt, or preparing to enter into a hunting lease arrangement, it is up to you to negotiate the terms and to protect your interests as you believe is appropriate. HCS invites you to visit the Site regularly and frequently. By doing so, you can best take advantage of the services that we offer. As a Subscriber, you are part of a community that depends on accurate and timely information. HCS will attempt to contact you via e-mail if we notice that you have not accessed the Site recently. If you do not reply to that e-mail within the time period specified, HCS will conclude that your information is outdated, and place you in an inactive status. This does not mean that you cannot access your account (we encourage you to do so), or that your paid membership has been terminated. It just means that, out of respect to our other Subscribers, they should know that your information might not be current. Once you respond to HCS’ e-mail notice and confirm that your information is current, your "inactive" status designation will be removed at our earliest possible convenience.

It is possible that viruses, worms, trojans, or other malicious code can be transmitted through the Site, just as with any other website. It is your responsibility to obtain such "anti-virus" protection as you believe is appropriate. By accessing this Site, you agree that HCS has no responsibility whatsoever for your failure to obtain such "anti-virus" protection, or the failure of such "anti-virus" protection to safeguard your computer system.

Because HCS does not conduct any investigation whatsoever into the qualifications of, history of, or truthfulness of the information submitted by Subscribers, HCS can not and does not guarantee, or even suggest that your hunting or leasing experience will be without problems. Obviously, the sports of hunting and fishing involve certain dangers and risks that can result in property damage, personal injury, and even death. By using any information obtained from this Site, you agree that HCS has no control over those events, and that HCS is acting only as an intermediary with no obligation to investigate or confirm. You also agree not to provide any information that you obtain from this Site to any non-Subscriber, and if you do, you assume the sole responsibility, and will indemnify and hold harmless HCS, for any legal actions, judgments, liabilities, damages, penalties, fines, or similar monetary expenses that arise in any way from such expenses incurred or imposed by reason, in whole or in part, of your providing such information to a non-Subscriber. In any event, you agree to indemnify, defend and hold harmless HCS from any legal actions, judgments, liabilities, damages, penalties, fines, or similar monetary expenses that arise in whole or in part from your use of the Site, including from matters which might result from HCS’ own sole negligence. To the extent that you obtain insurance relating to your hunting or fishing activities, you agree that you will name HCS as an additional insured with primary coverage.

At times, HCS may offer a message center service within the site. The message center feature of the Site is provided for your convenience and to enhance your use of the Site. Because of the real-time nature of the message center, it is impossible for HCS to review messages or to confirm the validity of information posted. HCS is absolutely not responsible for the contents of any posted messages or any event that arises in connection with such content. Although HCS has no responsibility or ability to monitor all message center messages, HCS does reserve the right to terminate any Subscriber’s access to the message center feature, or the Subscriber’s membership, if HCS believes that it is necessary. HCS hopes that the message center feature will be used by Subscribers solely for the purposes that are consistent with the Site, but can not guarantee that this will be the case. The only permissible postings are those that relate to the services offered by this Site. In using the message center feature, you agree that you will not post any message that you know is not true, defamatory to any person or entity, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person’s privacy, or otherwise in violation of any law. HCS's only objective is to provide members with a network of hunting contacts. While HCS strives to maximize the usefulness of your membership, HCS can not guarantee that any or all of the individual features of the Site will be maintained, continued, or available during the term of any Subscriber's membership, whether such membership is FREE or paid. To the extent reasonably possible, HCS will attempt to give advance notice to you of the discontinuation of any of those components. HCS also promises its Subscribers that we will carefully consider any feedback that you might have as to the individual components (for example, the message center, or the hunting gallery) as well as any other suggestions that you might have to make this Site more useful to you, and HCS will look forward to receiving your comments at info@huntclubservices.net . HCS wants to be your only source for hunting contacts.

In addition to the rules governing use of the message center feature of the Site, you agree that you will not under any circumstances, upload any photographs, caricatures, or other depictions to the Site that are of a human sexual nature, whether pornographic or not. You also agree that you will not upload any file of any type that contains a message that you know is not true, defamatory to any person or entity, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person’s privacy, or otherwise in violation of any law. If you violate these rules, HCS reserves the right to immediately terminate your membership without question or appeal.

The Site does use "Cookies" in order to help ensure that the information that you provide is kept up to date. (We realize that our customers’ needs and circumstances change from time to time. Since your information can only be updated by accessing the Site, the longer the period of time that passes between your visits to the Site, the more likely it is that some of your information might not be current). HCS’ use of "Cookies" will help the Site know when to notify Subscribers when it appears that the information you have submitted might be outdated. Hunting Auction Terms and User agreement 

All users must agree to these terms, or refrain from using the auction feature on this site.

We may amend this Agreement at any time by posting the amended terms on our site. Except as stated below, all amended terms shall automatically become effective 30 days after they are initially posted on our site. This Agreement may not be otherwise amended except in a written agreement signed by you and Hunt Club Services, LLC. This hunting auction agreement was last revised on May 25, 2008.

Neither Auction owners nor bidders may manipulate the bid on a property, nor may you interfere with any other user's property descriptions or bids.

Our services are available only to individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors. If you do not qualify, please do not use our services. Further, our services are not available to temporarily or indefinitely suspended Hunt Club Services registrants.

This Hunting Auction site acts as the venue for Hunt Club Services,LLC, landowners, Guide/Outfitters, realtors, sportsmen, hunt club managers, hunters/anglers to reach agreement on a recreational lease of properties, day hunts, Hunt Club Memberships or the sale of misc hunting related articles. We have no control over the quality or characteristics of the day hunts, hunt club memberships, lease properties or misc items advertised, the truth or accuracy of the information provided, the ability of landowners to lease the properties, the ability of the lessor to lease the property, or the hunting and fishing abilities of lessors who use the lease. We cannot ensure that a auction owner or bidder will actually complete a transaction.

Because user authentication on the Internet is difficult, Hunt Club Services, LLC cannot and does not confirm each user's purported identity. You may wish to consider using another entity of your choice to provide additional user verification.

In the event that you have a dispute with one or more users, you agree to release Hunt Club Services, LLC (and our officers, directors, agents, subsidiaries, franchises, and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

We do not control the information provided by users that is made available through our system. You may find other user's information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense, and practice safe trading when using our site. Please note that there are also risks of dealing with underage persons, or people acting under false pretense. By accepting this agreement users agree that they will not attempt to contact the owners or managers of any property controlled by Hunt Club Services, LLC in the Hunt Club Services system, directly or indirectly without written permission from Hunt Club Services, LLC. Any fraudulent activity or violations of this rule will result in termination of registration, a ban on future leasing to the user, and legal action.

Once you create a auction within this site or your bid is submitted to the Hunting Auctions on this site, you are expected to complete the transaction unless the transaction is prohibited by law or by this Agreement. By creating a auction or by bidding on a property, Club membership or hunting item, you agree to be bound by the terms included in the auction description, so long as those conditions are not in violation of this Agreement or unlawful. Bids are not retractable except in exceptional circumstances such as when the owner or creator of the auction materially changes or misrepresents the auction description, a clear typographical error is made, or the owner of the listings identity cannot be authenticated. If you choose to create a auction or if you choose to bid on a auction, you are certifying that you have the legal right and ability to participate in the transaction as described.

If Auction owners receive an acceptable bid, they are expected to complete the transaction, unless there is an exceptional circumstance, such as: (a) the bidder fails to meet the conditions of your description, or (b) Hunt Club Services, LLC cannot authenticate the winning bidders identity.

Auctions or Hunting Properties controlled by Hunt Club Services, LLC Terms and user agreement

Hunt Club Services, LLC may not actually visit all lands posted for lease on our site. Property descriptions may only include those property descriptions supplied to us.

 You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of our service and your bidding on, listing, purchase, solicitation of offers to rent, and rental of properties.

Without limiting any other remedies, Hunt Club Services, LLC may suspend or terminate your registration if you are found (by conviction, settlement, insurance, investigation, or otherwise) to have engaged in fraudulent activity in connection with our site.

Occupants of properties controlled by Hunt Club Services,LLC are required to carry a minimum of $1,000,000 hunting liability insurance or such other amount as landowner(s) deems necessary and with respect to Lessee's use of the premises for hunting/fishing purposes. Proof of such insurance is required and must be provided to Hunt Club Services, LLC before lessee is given permission to access the leased property under Hunt Club Services control. Hunt Club Services, LLC, Landowners and lessor must be added as additional insured on the policy.

All property auctions listed by The Hunt Club Services team or its staff are protected by the following rules or guidelines. Once your bid receives final approval from the landowner and Hunt Club Services, LLC, you will be contacted via email or telephone. Following that discussion a lease is drawn up and mailed to you for your signature. Full payment of the entire lease and required insurance (if applicable) is required when you mail the signed lease back to us. If the full payment and/or signed lease are not received in our office within 15 days of mailing from our office, the earnest deposit is forfeited and the lease immediately goes back on the market.

A lessee who fails to obtain the required insurance, or who defaults in performing any term or condition of the lease shall be subject to all legal and equitable remedies available to Hunt Club Services, LLC and the landowner under the lease or applicable law including, termination of the lease, with or without a refund of rents paid, denial of access to the premises, collection of damages to person or property, and attorneys fees and costs incurred by the landlord or Hunt Club Services, LLC

Any improvements made to enhance the hunting and/or fishing lease will be negotiated and agreed upon by Hunt Club Services, LLC representatives, the landowner, and lessee. All improvements, with the exception of personal property, remain with the land.
